About Us

Yavapai County’s Pre-trial Diversion Program is intended to provide an alternative method to hold low level offenders, whose offense has a nexus to substance abuse, accountable for violations of the law through participation in an evidence-based education or treatment program that targets factors related to re-offense. The Program is intended to effectively redirect limited criminal justice resources, bring about participants’ rehabilitation, and give rise to safer communities. The Program will divert criminal cases from formal court proceedings and allow for the dismissal of charges if the Program is successfully completed.

  • Intervene to prevent drug use and its collateral consequences
  • Hold participants accountable for their criminal conduct 
  • Rehabilitate participants by treating their underlying problems and addressing additional needs such as employment, food, clothing, shelter, and medical treatment
  • Assist participants in gaining insight into the harm caused by their conduct
  • Reduce collateral consequences of conviction for participants
  • Use prosecutorial and court resources more efficiently
  • Tailor responses to different types of participants (e.g. high risk and low risk)
  • Reduce re-offence
     

Enrollment

Participants for Yavapai County’s Pre-trial Diversion Program will be referred to Complete Care Partners by the Yavapai County Attorney, who is solely responsible for determining who is eligible for the Program. 
The Program is available as an alternative to prosecution either prior to filing charges (pre-file) or after charging (post-file). Following an individual comprehensive assessment and financial review, recommendations and a case management plan will be instituted, including referrals to appropriate treatment providers, along with the requirements for successful completion of the Program.

For pre-file participants who successfully complete the Program, the County Attorney Office, will not file the charges against the participant. For post-file participants who successfully complete the Program, the County Attorney’s Office will file a motion to dismiss the charges. If a participant fails to successfully complete the Program, the County Attorney’s Office will either file the charges or file a motion to reinstate prosecution.
